(People v. Anderson (1966) 64 Cal. 2d 633 [51 Cal. Rptr. 238, 414 P.2d 366].) Thereafter the remittitur was recalled and the judgment was reversed insofar as it related to the death penalty under the compulsion of Witherspoon v.
